These Terms of Service (“Terms”) govern your access to and use of our AI image and video generation service (the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

Eligibility & Accounts

You must be at least 13 years old (or the minimum legal age required in your country) to use the Service.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You agree to provide accurate information when creating an account (if accounts are enabled) and to keep that information up to date.
You must notify us if you believe your account has been compromised or used without your authorization.

Using the Service

The Service generates images and videos based on prompts and settings you provide. Results may be unpredictable and may not meet your expectations.

We do not manually review all prompts, uploads, or generated outputs. The Service operates through automated systems, and you understand that content may be processed without individual human review.

You are responsible for all prompts, files, and inputs you submit to the Service.
You are solely responsible for the legality, accuracy, and appropriateness of your prompts, uploads, and inputs.
You agree not to misuse the Service, attempt to bypass limits, or interfere with system operation, security, or performance.
We may apply automated filters, rate limits, and moderation measures to protect users, the Service, and third parties.

Plans, Packages, Limits

The Service may offer free and paid plans with different limits and features (for example: daily limits, hourly limits, cooldowns, storage limits, private mode, resolution limits, and priority processing).

Limits may apply to the number of generations, file uploads, resolution, speed, and/or storage.
We may enforce cooldowns and rate limits to prevent abuse and keep the Service available for everyone.
Plans, features, and limits may change over time to improve stability, address abuse, or respond to provider constraints.
We may suspend, restrict, or block access to generation features if we detect abusive behavior or excessive automated usage.

Payments & Billing

If you purchase a paid plan or package, payments are processed through third-party payment providers. We use two payment systems: Stripe and PayPal.

Payment information (such as card numbers or financial account details) is processed directly by Stripe or PayPal and is not stored on our servers.
We may receive limited transaction-related information (such as payment status, transaction ID, billing email, or subscription status) necessary to activate, manage, or verify your plan.
Subscriptions, if offered, may renew automatically unless canceled according to the applicable billing terms.
All payment processing, chargebacks, refunds, and disputes are subject to the terms and policies of Stripe and PayPal.

Your Content & Outputs

You keep ownership of the content you upload, provided you have the rights to upload it.
You represent and warrant that you have all necessary rights, licenses, and permissions to upload any content you submit to the Service.
Outputs are generated automatically. You are responsible for how you use, publish, distribute, sell, or share outputs.
Generated content may be similar or identical to content created for other users and may not be unique.
If private mode is available, private content is intended to be visible only to you unless you choose to share it.
If sharing links exist, anyone with the link may be able to access shared content. You are responsible for link sharing and access control.

Prohibited Uses

You agree not to use the Service for any unlawful, harmful, or abusive purpose. Prohibited uses include, without limitation:

Illegal content or illegal activity
Hate, harassment, threats, or promotion of violence
Sexual exploitation or any content involving minors
Impersonation, scams, fraud, deception, or misleading claims
Malware, hacking attempts, scraping, automated abuse, or bypassing limits/filters
Infringing content (copyright, trademark, publicity, or privacy rights) when you lack rights

We may suspend or terminate accounts that violate these rules and may remove or restrict access to content, with or without notice, to protect the Service and others.

Service Availability & Changes

The Service may experience interruptions, delays, failures, or errors. Generation requests may fail due to external providers, network conditions, maintenance, capacity limits, or other operational constraints.

We do not guarantee uninterrupted access or that the Service will always produce successful results.
We may update, modify, restrict, or discontinue parts of the Service at any time, including features, limits, or supported formats.

Disclaimers

The Service is provided “AS IS” and “AS AVAILABLE”, without warranties of any kind, express or implied. You use the Service at your own risk.

We do not guarantee output quality, accuracy, legality, completeness, or suitability for any purpose.
You are solely responsible for reviewing outputs before using them publicly, commercially, or in sensitive contexts.
You are responsible for ensuring your use of outputs complies with applicable laws and third-party rights.

Limitation of Liability

To the maximum extent permitted by law, we are not liable for any damages, losses, or claims arising out of or related to your use of the Service. This includes, without limitation:

lost profits, lost revenue, business interruption, or data loss
failures, delays, downtime, or errors caused by external providers or infrastructure
claims related to content you generate, upload, share, distribute, sell, or publish
third-party claims arising from your use of prompts, uploads, or outputs

You understand and agree that you are fully responsible for your actions, your inputs, and how you use outputs generated by the Service.

Indemnification

You agree to defend, indemnify, and hold us harmless from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from or related to:

your use of the Service
your prompts, uploads, and generated content
your violation of these Terms or any applicable laws
your infringement of third-party rights

Termination

We may suspend or terminate your access to the Service at any time if we believe you violated these Terms, abused the Service, or created risk for the Service or other users.

You may stop using the Service at any time. If account deletion is available, you may request deletion through your account settings or support.

Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes become effective means you accept the updated Terms.
